Terms of Use

OpenPayload is experimental, open software used across a community-operated network. No single developer owns, controls, or accepts responsibility for the network as a whole.

The plain version

Use OpenPayload at your own risk. The software and network are provided without warranties. No developer, contributor, maintainer, company, or independent network participant is liable for your use of—or inability to use—the Site, software, or network, to the fullest extent the law allows. Each participant is responsible only for its own systems and conduct; nobody assumes sole ownership or responsibility for the network as a whole.

Acceptance and scope

By accessing the OpenPayload website, documentation, software, or community-operated network (together, the “Services”), you agree to these Terms. If you do not agree, do not use the Services. Separate open-source licenses govern your right to copy, modify, and distribute particular software repositories; these Terms govern your use of the Site and network-facing Services.

A community-operated network

OpenPayload is a software protocol and an ecosystem of independently operated applications and infrastructure. Directory, Relay, Cache, Validator, gateway, application, and other services may be run by unrelated people or organizations. No developer, contributor, maintainer, or company—including Mandolare LLC—owns, controls, supervises, or operates every part of the network.

Participants do not become partners, agents, fiduciaries, joint venturers, or representatives of one another merely by implementing the protocol or connecting compatible software. One participant’s acts, omissions, availability, security, policies, or promises do not bind the others.

Your responsibility

You are solely responsible for the applications, nodes, keys, identities, policies, routes, payloads, content, security controls, backups, legal compliance, and operational decisions under your control. You must evaluate the operators and services you choose, keep credentials secure, obtain necessary rights and consents, and comply with applicable law.

Do not use the Services to violate law or rights, distribute malware, interfere with systems, evade access controls, misrepresent identity or authority, or transmit content you are not authorized to handle.

Experimental software

The Services are alpha-stage and may be incomplete, insecure, unavailable, changed, forked, suspended, or discontinued without notice. Payloads may be delayed, duplicated, corrupted, disclosed, misrouted, or lost. Policies, identities, keys, incentives, governance, and interoperability may behave differently across implementations.

Do not rely on the Services for emergencies, life safety, critical infrastructure, financial custody, regulated workflows, or sensitive or production data unless you independently determine that your implementation is fit for that purpose.

No warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES ARE DISCLAIMED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, ACCURACY, AND THAT DATA WILL BE DELIVERED, PRESERVED, OR KEPT CONFIDENTIAL.

No liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MANDOLARE LLC, OPENPAYLOAD DEVELOPERS, CONTRIBUTORS, MAINTAINERS, AND INDEPENDENT NETWORK PARTICIPANTS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF DATA, PAYLOADS, KEYS, PROFITS, REVENUE, REPUTATION, OR BUSINESS; SECURITY INCIDENTS; SERVICE INTERRUPTION; OR CLAIMS ARISING FROM OR RELATED TO THE SERVICES.

This limitation applies regardless of the legal theory and even if someone was advised that harm was possible. If applicable law does not allow a complete exclusion, aggregate liability will not exceed the greater of the amount you paid the party you are claiming against for the relevant Service during the prior 12 months or US $100. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Independent services and content

You may encounter third-party software, nodes, links, content, policies, or services. They are provided and governed by their respective operators. References or interoperability do not mean endorsement, control, or responsibility by Mandolare LLC or other OpenPayload contributors.

Changes, suspension, and severability

The Site operator may change or restrict the Site, and independent network operators may change or restrict their own services. These Terms may be updated by posting a revised version and effective date. Continued use after an update means you accept the revised Terms.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver.
